1. Terms & Conditions

1.1. Your access to and use of MyFitFinder and the services herein are subject exclusively to these Terms & Conditions.

1.2. By using MyFitFinder you accept and agree to be bound by the Terms & Conditions. If you do not accept these Terms & Conditions, you must immediately stop using MyFitFinder and/or services.

1.3. You agree to not use MyFitFinder and/or services for any purpose that is unlawful or prohibited by these Terms & Conditions.

1.4. MyFitFinder reserves the right to update or amend these Terms & Conditions at any time, and your continued use of MyFitFinder shall be deemed your acceptance of such changes. It is your responsibility to ensure you understand and check the Terms & Conditions for any changes.

1.5. Notwithstanding any legislative changes, MyFitFinder will review these Terms periodically for any updates or amendments.


2. MyFitFinder Service

2.1. MyFitFinder operates as an impartial intermediary between fitness services/businesses and users. MyFitFinder cannot accept any liability arising from contractual or consumer issues with third parties, or improper use of third party equipment.

2.2. MyFitFinder does not investigate or analyse the integrity, quality, safety, or any other aspect of the third party services operating on the site, and recommend that users carry out their own due diligence, and report issues and concerns to the third party directly where necessary.

2.3. MyFitFinder is an impartial party, and does not actively comment on, promote, or recommend any of the third party services operating and advertising on this site. Reviews and recommendations on MyFitFinder reflect the views of the users of those third party services and not those of MyFitFinder.

2.4. MyFitFinder may include links to third party websites that are controlled and maintained by those other than MyFitFinder. Links to other websites do not serve as endorsements for those websites, services, or businesses, and you accept that MyFitFinder has no control over such links or websites, and cannot be held liable or responsible for any content on or availability of any such websites.


3. “Business Services” Terms of Use

3.1. Fitness services/businesses operating on MyFitFinder are herein referred to as “third parties”, to distinguish them from MyFitFinder’s own operations.

3.2. Third parties operating on MyFitFinder are equally bound by these Terms, and must agree to uphold MyFitFinder’s minimum requirements on data privacy and handling of personal information for marketing purposes (see Section 5 for further details on personal information, data handling, and marketing data).

3.3. Third parties operating on MyFitFinder to advertise and reach new clients do hereby accept and agree to these Terms setting out that they will not use personal information and marketing data from MyFitFinder site or users without the express consent of the owner of the personal information and marketing data. Third parties breaching this clause shall be struck off and ordered to make reparations to the owner/s of the personal information and marketing data.

3.4. By using MyFitFinder to advertise their services and reach new clients, third parties accept all responsibility and liability for the contractual relationship between themselves and the user.


4. "Individual User” Terms of Use

4.1. Individual users on MyFitFinder are herein referred to as “users”, to distinguish them from fitness services/businesses and MyFitFinder’s own operations and personnel.

4.2. To use MyFitFinder users need to create an account. To create an account we require certain personal information to provide you with the best service, verify users identities to the best of our abilities, and take steps to safeguard our users’ safety (see Section 5 for further details on personal information, data handling, and marketing data).

4.3. By using MyFitFinder, you accept any and all responsibility for creating a secure password and maintaining the confidentiality of your password and account, for limiting the access to your account and device, and accepting responsibility for all activities that occur under your account and password (notwithstanding a proven malicious event such as hacking).

4.4. All users on MyFitFinder will adhere to a basic “code of conduct” when utilising the site to engage with other users, fitness services/businesses (“third parties”) and MyFitFinder personnel.

4.5. Individual users are prohibited from using this type of account to advertise a business, product, or service, or to reach new clients. Any individual user accounts found to be doing this will be suspended.

4.6. MyFitFinder reserves the right to remove access to, suspend, or block your account should you breach any of these Terms herein, with or without notice.


5. Privacy Policy: Personal Information & Marketing Data

5.1. MyFitFinder requires personal information from individual users and fitness services/businesses for the Site to operate. If you do not provide this information then you may not be able to access the entirety of the site, or find that some aspects do not function properly.

5.2. MyFitFinder will not sell, share, disseminate, or otherwise transfer your personal information for marketing purposes without your express consent. To this end, MyFitFinder has an “opt-in” function for marketing data.

5.3. In the unlikely event that personal information from MyFitFinder is shared without consent and is discovered by a user, you are required to let us know as soon as practicably possible about the breach. If the act is discovered by MyFitFinder, we will contact all users as soon as practicably possible and strongly recommend that you check your account security and information.


6. Severance

6.1. Should any of these Terms and Conditions be determined to be invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction then the relevant Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect, and continue to be binding and enforceable.


7. Governance

7.1. These Terms and Conditions so laid out shall be governed by and construed in accordance with the law of England and Wales, and you hereby submit to the exclusive jurisdiction to the courts of England and Wales.


8. Data Deletion

8.1. This sections sets out our policy for responding to requests for deletion of data under the GDPR (General Data Protection Regulation), which comes into force in May 2018. This section explains the rights of the data subject in relation to data deletion and the responsibilities of myfitfinder in responding with such a request.

8.2. An individual has the right to erasure, also known as ‘the right to be forgotten’. The principle underpinning this right is to enable an individual to request the deletion or removal of personal data where there is no compelling reason for its continued processing.

What information does myfitfinder retain?

8.4. The myfitfinder online system stores data about individuals in order to create a Team profile. We store the name, e-mail address, and fitness interests for each individual in order to create a profile, which is stored on our secure servers in Europe. This data is stored and used in accordance with the terms set out above.

If consent is provided, personal data (including the above, plus address, telephone number and notes) may be stored in our system for the purposes of contacting you regarding myfitfinder news, products and promotions.

How can my data be deleted?

8.5. A system administrator (individual user acting on behalf of their organization) can delete data from our system whenever they wish. This data is deleted from the system immediately and cannot be recovered by any users or myfitfinder employees after this point. Data which has been deleted or otherwise destroyed can not be recovered at any time. Sufficient warning is given to the account administrator before they permanently delete anything.

Data may still remain in the systems back-up files, which will be deleted periodically. Information may be deleted from our system upon request to info@myfitfinder.com. We undertake to perform the deletion within one month (30 calendar days) and will send you a confirmation once the information has been deleted. Wherever possible, we will aim to complete the request in advance of the deadline.
